Introduction

The following terms of use govern access to and use of the websites, mobile applications, and services of Keep Bike (the "Services") provided by Iskra Desenvolupament, owner of www.keepbike.com ("Keep Bike"). These terms apply together with the Privacy Policy and Cookie Policy.

By accessing or using the Services, or by creating an account using any of the available mechanisms, you expressly agree to these Terms of Use. If you do not agree with them, do not access or use the Services. Continued use of the Services after any modification of these terms implies acceptance of the same.

Service Description

Keep Bike is a web platform that allows users to manage the maintenance of their bicycles automatically and privately. The Services include recording bicycle and component usage, analyzing usage statistics, creating and managing maintenance alerts, and receiving personalized notifications.

To provide the Services, Keep Bike requires the User to connect through third-party activity tracking platforms ("Tracking Applications") such as Strava, and authorize access to the necessary data. This data includes information about the User's bicycles and registered cycling activities. Keep Bike does not store health data, detailed geographic location, or other sensitive User data. Keep Bike reserves the right to modify, suspend, or remove connectivity with any Tracking Application at any time, with or without prior notice, for technical, legal, or operational reasons.

Access to the Services is currently free. Keep Bike reserves the right to modify this business model at any time, notifying users with sufficient advance notice of any significant changes.

User Account

User authentication is performed exclusively through third-party Tracking Applications. Keep Bike never requests or stores passwords from third-party accounts. The User may revoke the Services' access to their data from Tracking Applications at any time from the privacy settings of the corresponding platform.

The User has the right to delete their account and all associated data at any time. To request account deletion, the User must send an email to info@keepbike.com from the email address associated with the account, expressly requesting deletion. Keep Bike reserves the right to suspend, restrict, or terminate access to the Services for any User who violates these Terms of Use, uses the Services fraudulently, or engages in any activity that may damage the integrity, security, or operation of the Services or affect other users.

Intellectual Property

All intellectual property rights over the Services, including but not limited to software, design, logos, trademarks, content, and functionalities, belong to Iskra Desenvolupament or its licensors. The User does not acquire any property rights over the Services through their use.

The User agrees not to copy, modify, distribute, sell, or license any part of the Services without prior written authorization from Keep Bike.

Privacy and Data Protection

Keep Bike does not guarantee that the Services will be uninterrupted, timely, secure, or error-free, nor that defects will be corrected. The User uses the Services at their own risk.

Keep Bike does not provide mechanical, maintenance, or safety advice related to bicycles. The recommendations, alerts, and information provided by the Services are for guidance only and do not constitute professional advice. The User expressly agrees that Keep Bike will not be responsible in any way for accidents, injuries, material or personal damage, or any other consequence arising from the use of or reliance on information provided by the Services.

In no event shall Keep Bike, Iskra Desenvolupament, or its partners, directors, employees, or agents be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses.

Indemnification

The User agrees to indemnify and hold harmless Keep Bike, Iskra Desenvolupament, and its partners, directors, employees, and agents from any claim, damage, loss, liability, and expense (including attorneys' fees) that may arise from the User's use of the Services or violation of these Terms of Use.

Modification of Terms

Keep Bike reserves the right to modify these Terms of Use at any time. Modifications will take effect from the moment of their publication on the website. Continued use of the Services after publication of modifications implies acceptance of the new terms.

Keep Bike will notify users of any significant changes to the Terms of Use through notification on the website or by email to the address associated with the User's account.

Applicable Law and Jurisdiction

These Terms of Use are governed by Spanish law. For any controversy that may arise, the parties agree to attempt to resolve it amicably. Otherwise, they submit to the courts and tribunals of Barcelona, expressly waiving any other jurisdiction that might correspond to them.
